AIGLE MEMBERSHIP CLUB - TERMS & CONDITIONS (APPLY TO HONG KONG AND MACAU STORES AND CORNERS ONLY)

These Terms and Conditions (the “T&C”) govern the AIGLE Membership Club offered to the customers of the AIGLE stores and corners located in Hong Kong and Macau and, as the case may be, to the users of the AIGLE website www.aigle.com.hk. The AIGLE Membership Club is also subject to our Personal Information Collection Policy.

By joining the AIGLE Membership Club and thereafter by being a member of the AIGLE Membership Club, you agree to the provisions of the present T&C and acknowledge that we reserve the right to amend them from time to time without notice. We therefore recommend you to check the content of these T&C regularly.

You have the possibility at any time to quit the AIGLE Membership Club by contacting our Customer Service. We also reserve the right to cancel the AIGLE Membership Club at any time.

Any reference to “we”, “us” and “our” in these T&C is intended to refer to Green Square Marketing Ltd., Aigle (Macao) Ltd. and/or Aigle Hong Kong Ltd.

  1. There are four membership tiers in the AIGLE Membership Club, namely GREEN, SILVER, GOLD and PLATINUM as further described in the the AIGLE Membership Club leaflet which forms an integral part of these T&C .

  2. The initial membership period for each membership tier is as follows:

    GREEN – permanent from the joining date;

    SILVER – until 31st December of the year following the year during which the SILVER membership is acquired; for example, if the SILVER membership is acquired on 15th May 2018, the related membership period runs until 31st December 2019;

    GOLD – until 31st December of the second year following the year during which the GOLD membership is acquired; for example, if the GOLD membership is acquired on 15th May 2018, the related membership period runs until 31st December 2020;

    PLATINUM – one year, from 1st January until 31st December.

  3. The SILVER membership is subject to the initial spending requirement as specified in the the AIGLE Membership Club leaflet. The SILVER membership will be renewed automatically for one year at the end of the membership period if any purchase (of whatever amount) in an AIGLE store or corner in Hong Kong or Macau is made during the membership period. The SILVER membership will automatically expire at the end of the membership period if there is no purchase during the membership period.

  4. The GOLD membership is subject to the initial spending requirement as specified in the the AIGLE Membership Club leaflet. The GOLD membership will be renewed automatically for two years at the end of the membership period if any purchase (of whatever amount) in an AIGLE store or corner in Hong Kong or Macau is made during the membership period. A GOLD membership will be changed to a SILVER membership if there is no purchase during the GOLD membership period.

  5. The PLATINUM membership is by invitation from us only. GOLD members upon spending a designated amount within one calendar year as specified in the AIGLE Membership Club leaflet will be invited to be PLATINUM members in next calendar year. The PLATINUM membership will be renewed for one year at the end of the membership period if the spending requirement in AIGLE stores or corners in Hong Kong or Macau during the membership period as specified in the the AIGLE Membership Club leaflet is reached. A PLATINUM membership will be changed to a GOLD membership if the spending requirement is not met during the PLATINUM membership period.

  6. GOLD and PLATINUM members are entitled to Bonus Points Scheme starting from the next purchase after becoming a GOLD member or a PLATINUM member.

  7. Every HK$1 or, as the case may be, every MOP$1 (net payment after deductions of discount, points redemption, gift vouchers and/or any other coupons/rebates) spent in an AIGLE store or corner in Hong Kong or Macau can be converted into 1 bonus point. GOLD and PLATINUM members are required to provide to the sales staff their membership number, registered name and/or mobile phone number before the sales memo/receipt is issued in order to earn bonus points.

  8. Every 10,000 bonus points earned can be redeemed for HK$500 or MOP$500 as a cash rebate deducted from the payment of a transaction in a single sales ticket made in an AIGLE store or corner in Hong Kong or Macau. If a GOLD or PLATINUM member wishes to redeem cash rebate in a transaction, the related payment shall necessarily be made by Visa, MasterCard, AE, UnionPay or JCB. Besides, in order to protect members upon redemption, members must show their credit card and/or ID card for verification by the sales staff.

  9. Any error found on a member’s bonus point information (points used, points earned and/or points balance) as appearing on a sales memo/receipt shall be reported by such member to our Customer Service or to the sales staff of any AIGLE store or corner in Hong Kong or Macau within fourteen (14) days after the date of the related purchase, otherwise the member is deemed to agree with its bonus point status shown on the sales memo/receipt.

  10. Each bonus point earned is valid for a period starting from the date of the corresponding purchase until 31st December of the second year following the year during which the corresponding purchase was made; for example, a bonus point earned with respect to a purchase made on 15th May 2018 is valid until 31st December 2020. Each bonus point will be lapsed upon its expiry date or when a member is no longer a PLATINUM or a GOLD member.

  11. Any unused bonus points upon membership expiry will be lapsed.

  12. Change of membership between GOLD and PLATINUM will not change the bonus point balance and expiry date in a member’s account.

  13. If a member has earned bonus points from a transaction which is subsequently cancelled or reversed for whatever reasons, the associated bonus points will be cancelled or reversed at the same time.

  14. The bonus points cannot be exchanged for cash, other gifts or privileges.

  15. Any purchases/transactions made during the Privilege Days or in AIGLE factory outlets are not applicable to and within the AIGLE Membership Club including, without limitation, the bonus points scheme.

  16. The AIGLE membership and bonus points are strictly personal and are non-transferable.

  17. Members’ information such as member’s name, membership number, bonus point balance as appearing on a sales memo/receipt is valid only if it complies with our own records.

  18. Members are responsible for updating their personal information whenever there is a change, in accordance with our Personal Information Collection Policy.

  20. In case of disputes as to the interpretation or implementation of these T&C , we reserve the right for final and conclusive decision.

  21. These T&C are made in the English and Chinese languages. The Chinese version hereof is for reference only. In case of inconsistency or discrepancies, the English version shall prevail.

  22. These T&C shall be subject to the laws of the Hong Kong Special Administrative Region and the courts of the Hong Kong Special Administrative Region shall have exclusive jurisdiction in relation thereof.



AIGLE MEMBERSHIP CLUB - PERSONAL INFORMATION COLLECTION POLICY

This Personal Information Collection Policy (the “Policy”) applies with respect to the AIGLE Membership Club offered to the customers of the AIGLE stores and corners located in Hong Kong and Macau and, as the case may be, to the users of the website www.aigle.com.hk. The Aigle Membership Club is also subject to the related Terms and Conditions.

By joining the AIGLE Membership Club and thereafter by being a member of the AIGLE Membership Club, you agree to the terms of this Policy and acknowledge that we reserve the right to amend them from time to time without notice. We therefore recommend you to check the content of this Policy regularly.

You have the possibility at any time to quit the AIGLE Membership Club by contacting our Customer Service. We also reserve the right to cancel the AIGLE Membership Club at any time.

Any reference to “we”, “us” and “our” in this Policy is intended to refer to Green Square Marketing Ltd., Aigle (Macao) Ltd. and Aigle Hong Kong Ltd.

This Policy is made in the English and Chinese languages. In case of inconsistency or discrepancy, the English version shall prevail.

We hereby commit to take all reasonable measures to ensure the protection of your personally identifiable information, including, without limitation, your name, gender, date of birth, telephone number, e-mail address and mail address (“Personal Data”).

  1. Collection of Personal Data
    We collect Personal Data at the time you join the AIGLE Membership Club. We may also ask you to supply additional Personal Data at any time thereafter. You are not obliged to provide us with Personal Data but if you fail to do so, you may not be able to become or, as the case may be, to remain a member of the AIGLE Membership Club or to enjoy all of its benefits.

  2. Purpose and use of Personal Data
    We will use the Personal Data collected from you:
    -for direct marketing and promotion through different formats (such as, without limitation, electronic emails, SMS, phone calls or mails) regarding fashion apparel, shoes, rubber boots, and also for member events, news, special promotions and services in relation to the AIGLE brand and products,
    -for any other purposes incidental or directly related to the above.

    You may refuse to receive marketing and promotion materials from us by checking the suitable box in the relevant application form and, at any time after registration, by opting-out as may be indicated in said materials or by contacting our Customer Service.

  3. Transfer of Personal Data
    We will not disclose or transfer your Personal Data without your prior consent to any third parties other than:
    - our holding company Aigle International S.A. which is incorporated in France;
    - our authorized third party contractors and those of Aigle International S.A., such as, without limitation, the contractors in charge of the storage and/or processing of Personal Data; and
    - any person or entity when required by law, a court order or by any government, regulatory or administrative authorities.

    Therefore you acknowledge that your Personal Data may be transferred to jurisdictions outside of Hong Kong and Macau, in particular, without limitation, to France.

  4. Processing of Personal Data
    Your Personal Data will be processed directly by us, by Aigle International S.A., by our authorized third party contractors and/or by those of Aigle International S.A. through electronic and automated means.

  5. Security and retention of Personal Data
    Reasonable efforts will be made to ensure to safeguard and keep your Personal Data in a secured way and that your Personal Data can only be accessed by our employees, those of Aigle International S.A. and the employees of our and Aigle International’s authorized contractors. However complete security cannot be guaranteed and you acknowledge that the provision of Personal Data to us is made at your own risk. To the extent permissible by applicable law, we are not responsible for any direct, indirect, consequential or special damages arising out of or further to the provision of Personal Data by you to us.

    Your Personal Data will only be kept for a reasonable period as required to fulfill the purposes for which they are collected.

  6. Accuracy of Personal Data
    When providing us with Personal Data, you represent and warrant that you are using your actual identity. Your Personal Data shall be true, accurate, current and complete in all respects as at the time of provision.

    If you are under the age of 18, you must provide us with a written authorization from a parent or guardian in order to join the AIGLE Membership Club.

    It is your responsibility to inform us and request correction in case of change to or inaccuracy of your Personal Data held by us.

  7. Access to and correction of Personal Data
    You have the right to request access to and/or correction of your Personal Data provided to us at any time by contacting our Customer Service. We may, at our own discretion, charge you a reasonable fee for the processing of any such request of access and/or correction.

  9. Severability
    If any of the provisions of this Policy is deemed to be invalid, illegal, or for any reason unenforceable, that provision will be deemed severable and will not affect the validity, legality or enforceability of the remaining provisions.
